Please read these Terms & Conditions carefully before enrolling, participating in classes, or using any services offered by Diamond Martial Arts & Fitness, LLC. By enrolling or participating, you acknowledge that you have read, understood, and agree to be bound by these terms.

SECTION 1 — MEMBERSHIP & ENROLLMENT

Enrollment Requirements
Enrollment in Diamond Martial Arts & Fitness, LLC ("the School") is open to individuals of all ages. Students under the age of 18 must have a parent or legal guardian complete all enrollment documentation and provide written consent prior to participation.
Membership Types
The School offers the following membership options:
• Month-to-Month Membership – A flexible membership with no long-term commitment, billed monthly.
• 12-Month Membership Agreement – An annual commitment offering preferred tuition rates, billed monthly over the agreement term.
• Introductory / Trial – A limited introductory experience for new prospective students.
Class Schedule & Changes
The School reserves the right to adjust class schedules, locations, and instructor assignments as necessary. Members will be notified of any significant changes in advance. The School is not responsible for individual scheduling conflicts that may arise from such adjustments.
Membership Holds
Members may request a temporary hold on their membership for qualifying reasons (e.g., medical, relocation, extended travel). Hold requests must be submitted in writing. During an approved hold, the member's tuition rate will be preserved, and no billing will occur for the duration of the hold period. Specific hold terms are governed by your signed membership agreement.
Cancellation
Month-to-month memberships may be cancelled with written notice as specified in the membership agreement. 12-month memberships may be cancelled prior to the end of the agreement term subject to an early termination fee, as outlined in the signed agreement. The School reserves the right to cancel or suspend a membership for violations of the Code of Conduct or non-payment.

SECTION 2 — PAYMENT & REFUND POLICY

Tuition & Billing
Tuition is billed on a recurring monthly basis on the date specified in your membership agreement. Accepted forms of payment include major credit/debit cards and ACH bank drafts where available. All tuition is charged in advance of the service period.
Late Payments
Accounts more than [X] days past due may result in suspension of membership privileges. The School reserves the right to assess a late fee for overdue balances, as detailed in your signed membership agreement.
Refund Policy
Tuition payments are generally non-refundable once a billing cycle has begun. Exceptions may be considered on a case-by-case basis at the sole discretion of school management. Refunds will not be issued for missed classes due to personal scheduling conflicts, illness, or other student-related reasons. In the event the School cancels a class or session, makeup opportunities will be offered when possible.
Early Termination Fee
Students who wish to exit a 12-month membership agreement before the end of the term will be subject to an early termination fee as defined in their signed agreement. This fee compensates the School for the reduced-rate tuition provided under the long-term agreement structure.
Returned Payments
Returned checks or failed electronic payments may be subject to a returned payment fee. The member is responsible for promptly resolving any failed payment.

SECTION 3 — LIABILITY & WAIVERS

Martial arts training involves physical activity and inherent risks. By enrolling, you acknowledge and accept these risks on behalf of yourself and/or your minor child.
Assumption of Risk
Participation in martial arts training, including but not limited to sparring, board-breaking, physical conditioning, and weapons training, involves a risk of physical injury. Students and their guardians voluntarily assume all risks associated with participation, whether or not such risks are foreseeable.
Release of Liability
By enrolling, you release and hold harmless Diamond Martial Arts & Fitness, LLC, its owners, instructors, volunteers, agents, and affiliates — including the American Taekwondo Association (ATA) — from any and all claims, damages, losses, or liabilities arising from participation in any class, event, or activity offered by the School, whether caused by negligence or otherwise.
Medical Conditions
Students with known medical conditions, physical limitations, or recent injuries must notify the School prior to participation. Diamond Martial Arts & Fitness, LLC is not a medical provider and does not offer medical advice. It is the student's (or guardian's) responsibility to obtain medical clearance before beginning or continuing training.
Emergency Medical Authorization
In the event of a medical emergency during class or a School-sponsored event, the School and its staff are authorized to seek emergency medical assistance on behalf of the student. Any costs associated with such emergency care are the sole responsibility of the student or guardian.
Separate Waiver Required
All students are required to sign a separate Student Participation Waiver prior to their first class. The waiver governs the release of liability in greater detail and is incorporated herein by reference.

SECTION 4 — CODE OF CONDUCT

Diamond Martial Arts & Fitness, LLC is committed to maintaining a safe, respectful, and positive training environment for students of all ages and backgrounds. All students, parents, guardians, and visitors are expected to conduct themselves in accordance with the following standards.
Core Expectations
• Treat all students, instructors, staff, and guests with respect and dignity at all times.
• Arrive on time, in proper uniform (dobok), with a clean and respectful appearance.
• Refrain from the use of profanity, aggressive language, or disrespectful behavior on or near school premises.
• No bullying, intimidation, harassment, or discriminatory conduct will be tolerated.
• Students must follow all instructor directions during class and yield to the authority of school leadership.
• Unauthorized physical contact, horseplay, or unsupervised sparring is strictly prohibited.
• Alcohol, tobacco, controlled substances, and weapons not related to approved curriculum are prohibited on school premises.
ATA Martial Arts Values
As an ATA-affiliated school, Diamond Martial Arts & Fitness upholds the core tenets of Taekwondo: Courtesy, Integrity, Perseverance, Self-Control, and Indomitable Spirit. All students are expected to embody these values both inside and outside of the dojang.
Consequences for Violations
Violations of the Code of Conduct may result in a verbal warning, suspension from class, or permanent termination of membership at the sole discretion of school management. No refund of tuition will be issued in the event of conduct-related membership termination.
Social Media & Online Behavior
Students and families are expected to represent the School positively online. Defamatory, harassing, or disparaging content directed at the School, its staff, or fellow students may be grounds for membership suspension or termination.

SECTION 5 — PRIVACY POLICY

Information We Collect
We collect personal information necessary to administer your membership, including:
• Full name, date of birth, and contact information
• Emergency contact details
• Payment information (processed securely through our billing provider)
• Health disclosures relevant to safe participation
• Photos or videos taken during class or school events (with consent)
How We Use Your Information
Your information is used to:
• Process enrollment, billing, and membership management
• Communicate class schedules, school news, and promotions
• Ensure the safety and wellbeing of all participants
• Fulfill obligations to ATA International as an affiliated school
ATA Data Sharing
As an ATA International-affiliated school, certain student data (such as name, rank, and testing records) may be shared with ATA International for the purposes of rank certification, curriculum tracking, and membership in the ATA organization. This information is governed by ATA's own data policies.
Photography & Media
Diamond Martial Arts & Fitness, LLC may photograph or video record students during classes or events for promotional and educational purposes. By enrolling, you grant the School a non-exclusive license to use such images or recordings for school marketing materials, social media, and related purposes. If you do not wish to be photographed, please notify us in writing.
Data Security
We take reasonable steps to protect your personal information from unauthorized access or disclosure. Payment information is processed through encrypted, PCI-compliant third-party processors. We do not sell your personal information to third parties.
Communications
By providing your contact information, you consent to receive communications from the School regarding your membership, class schedules, events, and promotions. You may opt out of promotional communications at any time by contacting us.

SECTION 6 — ATA AFFILIATION & INTELLECTUAL PROPERTY

About Our ATA Affiliation
Diamond Martial Arts & Fitness, LLC is a licensed member school of ATA International (American Taekwondo Association). Our curriculum, rank structure, testing standards, and many of our training materials are provided under our affiliation with ATA International. Students who earn ranks through our program receive certifications recognized by ATA International.
ATA Intellectual Property
The ATA curriculum, forms (poomsae/forms), training manuals, instructional videos, rank insignia, logos, trademarks, and related materials are the intellectual property of ATA International. These materials are licensed to Diamond Martial Arts & Fitness, LLC for use in delivering ATA-sanctioned instruction. Unauthorized reproduction, distribution, recording, or commercial use of ATA curriculum or materials by students, parents, or third parties is strictly prohibited and may constitute copyright infringement.
School Intellectual Property
All original content created by Diamond Martial Arts & Fitness, LLC — including but not limited to training programs, promotional materials, website content, and school-developed curricula — is the property of Diamond Martial Arts & Fitness, LLC. Reproduction or use of such materials without written permission is prohibited.
ATA Membership & Testing Fees
Certain ATA-related services, including rank testing, ATA membership, and tournament participation, may carry separate fees established by ATA International. These fees are in addition to school tuition and are subject to change based on ATA's policies. The School will provide advance notice of applicable ATA fees.
ATA Code of Ethics
All students are expected to uphold the ATA Code of Ethics, which aligns with the values of respect, discipline, and integrity central to the martial arts tradition. Conduct that violates the ATA Code of Ethics may affect a student's standing within the ATA organization.
